Swatch: Faces Of Samsung’s Smart Watch Breached Trademark

A complaint has been filed by Swatch Group against Samsung Electronics America Inc and Samsung Electronics Co. It said that the two firms infringed its trademark on the designs for its downloadable faces for the smartwatch of Samsung.

The Swiss watchmaker said that the watch faces of the Korean companies “bear identical or virtually identical marks,” to the trademarks that it uses and owns on its brands which include Omega, Longines, Tissot, and Swatch.

In a filing to the court in the Southern District of New York, Swatch Group stated: “This unabashed copying of the Trademarks can have only one purpose – to trade off the fame, reputation, and goodwill of the Swatch Group Companies’ products and marks built painstakingly over decades.”

Swatch has demanded a trial in the complaint. It also alleges unfair competition and unfair business practices. It was not immediately available for comment regarding the matter.

Samsung was also not immediately available to comment.
